Blind Item- Could also be called a blind purchase. The buyer need not be literally "blinded" or prohibited from examining the item for sale. The defining characteristic of the transaction is as follows. Even when the purchaser is allowed to look at, hold, try out, etc., the item he is considering, he is unable to make a rational judgment about it.

Illustration: Quite literally, he does not know what he is looking at. He lacks a frame of reference. He can not make reasonable comparisons. He sees what he is told to see--much as when the average motorist's mechanic points to the water pump, alternator, or master cylinder. The prospective violin buyer might as well be standing in line for a lottery ticket or participation in a "grab bag" sale. But he does not think of his activity in this way. Therefore, he is all the more easily victimized, taken advantage of, "take to the cleaners," or just plain "taken"

Bribe- A price, reward, or favor--most often consisting of money and/or property--bestowed or promised by a seller, to the end that the recipient will permit his judgment and conduct to be corrupted. Persons in positions of trust are favored as recipients, since their positions make them promising matchmakers.

Collusion- A secret combination, or concert of action between two or more persons for (a) fraudulent or deceitful purpose(s).

Commercial Bribery- This type of bribery is related to unfair trade practices. It causes an advantage which one competitor secures over his fellow competitor(s) by his secret and corrupt dealings with employees and/or agents of prospective purchasers--i.e., with matchmakers.

Deceit- A fraudulent and deceptive misrepresentation, artifice, or device, used by one or more persons to deceive and trick another (this individual being ignorant of the true facts)--and to the prejudice and damage of the party imposed upon.

fair market value-
U.S. Treasury regulation, paragraph 20.2031-6.
"The price at which the property will change hands between a willing buyer and a willing selling, neither party being under compulsion to buy or sell and both having reasonable knowledge of relevant facts."

fiduciary-
A person with a duty to act primarily for the benefit of another (duty to be loyal).
A fiduciary relationship may be conferred by written or implied contract.

finder's fees-
A hidden commission or kickback paid by the seller to a third part for arranging the sale.
Examples in the violin business are teachers, orchestra directors, etc., just for delivering the purchaser to the seller. (private owner, dealer, other students)

Fix- Used both as a noun and a verb, though the verbal (active) meaning is primary. Thus, "to fix": to arrange or influence an outcome, decision, choice, etc., by collusion or a bribe (q.v.).

Fraud- An intentional perversion of truth for the purpose of inducing another, in reliance upon it, either to part with some valuable thing (e.g., money) which belongs to him, or to surrender a legal right. A misrepresentation of a matter by false or misleading allegations, or by concealment (Effected through words, action, or both) of that which should have been disclosed--which deceives and is intended to deceive another, so that he shall act upon it to his legal injury.

Forgery- The act of forging, especially the illegal production of something counterfeit. Something counterfeit, forged, or fraudulent.

Graft- The unscrupulous use of one's position to derive profit or advantages: extortion. Also, any money of advantage gained or yielded under such circumstances.

Gull- A person who is easily fooled; dupe. To deceive, dupe

Kickback- A seller's secret rebate of part of a purchase price--said rebate being paid, not to the buyer, but to the individual who directed or influenced the purchaser to buy from this particular seller. Liebhaberpreise-
German origin- "The price one is willing to pay due to OVER INFATURATION" and not because the price is based on normal and relevant information.

list prices-
The manufacturers suggested catalog retail price. This price includes the cost to the dealer as well a gross profit which includes overhead and net profit.

Misrepresentation- Any manifestation, whether by words or actions, made by one person to another, which--under the circumstances--amounts to an assertion not in accordance with facts. An untrue statement of fact. An incorrect or false representation (upon which another may be expected, or induced, to rely).

Re-graduation- A practice of rethinning the wood from the top, back, or ribs which is unethical and irreversible. The process destroys the "essential original parts" for only a temporary improvement in tone. Some dealers disguise this instrument abuse as "Acoustical Refinement", or "Acoustical Tone Improvements".  REGRADUATION, WHAT IS IT?
